Acceptance of Terms

Welcome to Extro. By accessing or using the Extro mobile application (the "App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the App.

These Terms constitute a legally binding agreement between you and Extro ("we," "our," or "us"). We reserve the right to update these Terms at any time, and your continued use of the App constitutes acceptance of any modifications.

Description of Service

Extro is an event discovery mobile application that helps you find, save, and organize events. The App provides the following features:

• Social Media Link Extraction: Discover events by sharing links from social media platforms such as Instagram, Facebook, and TikTok. The App extracts event details from publicly available content.
• Screenshot Analysis: Import event information by sharing screenshots. The App uses AI-powered analysis to extract event details from images.
• Manual Entry: Create and manage events manually by entering event details directly into the App.
• Event Organization: Save, categorize, and set reminders for events you are interested in.
• Location-Based Discovery: Find events near you using location-based recommendations.

User Accounts and Responsibilities

Account Creation

To use certain features of the App, you must create an account. You agree to provide accurate, current, and complete information during registration and to keep your account information up to date.

Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

Age Requirement

You must be at least 13 years of age to use the App. By creating an account, you represent and warrant that you meet this age requirement.

Acceptable Use Policy

You agree to use the App only for lawful purposes and in accordance with these Terms. You agree not to:

• Use the App in any way that violates any applicable federal, state, local, or international law or regulation
• Submit false, misleading, or fraudulent event information
• Attempt to gain unauthorized access to any part of the App, other accounts, or any systems or networks connected to the App
• Use the App to transmit any unsolicited or unauthorized advertising, promotional materials, or spam
• Impersonate or attempt to impersonate another user, person, or entity
• Use any automated means, including bots, scrapers, or crawlers, to access the App or collect data
• Interfere with or disrupt the App or servers or networks connected to the App
• Upload or share content that is illegal, harmful, threatening, abusive, defamatory, or otherwise objectionable

Intellectual Property

Our Intellectual Property

The App and its entire contents, features, and functionality (including but not limited to all information, software, text, displays, images, and the design, selection, and arrangement thereof) are owned by Extro, its licensors, or other providers of such material and are protected by copyright, trademark, patent, trade secret, and other intellectual property laws.

Your Content

You retain ownership of any content you submit, post, or display through the App, including manually created events and shared links. By submitting content, you grant us a non-exclusive, worldwide, royalty-free license to use, reproduce, and process such content solely for the purpose of operating and providing the App's services to you.

Feedback

Any feedback, suggestions, or ideas you provide regarding the App may be used by us without any obligation to you.

Third-Party Services

Meta (Instagram/Facebook)

• The App uses Meta's oEmbed API to retrieve publicly available metadata from Instagram and Facebook posts for event extraction.
• Your use of content from Instagram and Facebook is subject to Meta's Terms of Service.

TikTok

• The App uses TikTok's oEmbed API to retrieve publicly available metadata from TikTok videos for event extraction.
• Your use of content from TikTok is subject to TikTok's Terms of Service.

Google (Gemini AI)

• The App uses Google's Gemini AI services to analyze content and extract structured event information from social media posts and screenshots.
• Use of Google services is subject to Google's Terms of Service.

Apple

• If you access the App through an Apple device, your use is also subject to Apple's Licensed Application End User License Agreement.
• Apple is not responsible for the App or its content.

We are not responsible for the content, privacy policies, or practices of any third-party services. We encourage you to review the terms and privacy policies of any third-party services you interact with through the App.

Disclaimer of Warranties

THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:

• IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT
• WARRANTIES THAT THE APP WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE
• WARRANTIES REGARDING THE ACCURACY OR RELIABILITY OF EVENT INFORMATION EXTRACTED FROM SOCIAL MEDIA POSTS, SCREENSHOTS, OR OTHER SOURCES
• WARRANTIES THAT ANY ERRORS IN THE APP WILL BE CORRECTED

Event information displayed in the App is extracted from third-party sources and user submissions. We do not guarantee the accuracy, completeness, or timeliness of any event information. You should always verify event details directly with the event organizer.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL EXTRO, ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION:

• Loss of profits, data, use, goodwill, or other intangible losses
• Damages resulting from your access to or use of (or inability to access or use) the App
• Damages resulting from any conduct or content of any third party on the App
• Damages resulting from unauthorized access, use, or alteration of your transmissions or content
• Damages resulting from inaccurate event information obtained through the App

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATING TO THE APP EXCEED THE AMOUNT YOU HAVE PAID US IN THE TWELVE (12) MONTHS PRIOR TO THE EVENT GIVING RISE TO THE LIABILITY, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.

Termination

We may terminate or suspend your account and access to the App immediately, without prior notice or liability, for any reason, including without limitation if you breach these Terms.

Upon termination:

• Your right to use the App will immediately cease
• We may delete your account and all associated data
• All provisions of these Terms which by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability

You may terminate your account at any time by deleting your account through the App's settings or by contacting us at support@extro.app.

Changes to Terms

We reserve the right to modify or replace these Terms at any time at our sole discretion. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect by posting the updated Terms within the App and updating the "Last Updated" date.

Your continued use of the App after any changes to these Terms constitutes your acceptance of the new Terms. If you do not agree to the new Terms, you must stop using the App.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.

Any disputes arising out of or relating to these Terms or the App shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action.
